Liability Waiver

You understand that you may not transfer your access credentials to another person and that your membership is for your sole use. You understand that you are responsible for the conduct of any unauthorized person that accesses the facility through your credentials, regardless of your knowledge of their use. You agree to indemnify Momentum Fitness, including the payment of the facility’s reasonably incurred attorney’s fees for any potential or incurred liability arising out of unauthorized guests using your facility entry credentials.

Any exercise program you engage in should be approved by your physician prior to commencement. Your use of Momentum Fitness equipment, facilities, and classes is at your own risk.

You may be using the facility at times when the facility is unattended by staff or other members. You assume the risk of injury due to equipment failure, improper form, conduct of yourself and others using the facility, or other causes related to lack of supervision, and waive any claim arising out of the facility being unsupervised or unattended.

In full consideration of the above-mentioned risks and hazards, you are willingly and voluntarily participating in self-administered activities using the equipment and facilities. You hereby waive, release, and discharge Momentum Fitness and its successors, members, managers, owners, and staff of any and all liability, claims, demands, or damages of any kind related to, arising from, or in any way connected with your participation in training and/or your use of the equipment and facilities.
