Terms of Sale

Sole Use

I understand that the membership I am signing up for is for my sole use. I cannot share my membership or access credentials with another person under any circumstances. I understand that sharing a membership is theft and will be treated as such.


I understand that if I no longer wish to be a member or I am no longer using my membership for any reason, I cannot transfer my membership to someone else.

Annual Fees

I understand that the annual fee is charged upon joining, then annually for each year of continuous membership.


In the event that I terminate my membership and rejoin, I understand that I will need to pay the annual fee again, even if I am rejoining within a year of having previously paid the annual fee.

Membership Termination

Autopay Memberships

 

As Momentum Fitness does not require members to sign long-term contracts, I understand that is my responsibility to be aware of my membership’s autopay dates and manage my membership accordingly.


I understand that it is my responsibility to terminate my own membership following the steps outlined on the Momentum Fitness website under Frequently Asked Questions when I no longer wish to be a member. 


I understand that it is my responsibility to terminate my own membership more than 24 hours before my next autopay is scheduled to avoid additional charges.


I understand that because I can cancel at any time, any chargebacks I request through my credit card company will be responded to with this document showing that I understand there are no circumstances under which I am unable to terminate my own membership. I understand that I do not need to request termination from Momentum Fitness staff in order to terminate my membership.

Third Party Memberships

I understand that 6 months of inactivity on my Momentum Fitness membership will result in my Momentum Fitness membership being terminated. To reinstate my Momentum Fitness membership, I must contact accounts@momentumfit.org.

I understand it is my responsibility to notify Momentum Fitness when I am no longer a participant in the third party program I am enrolling with. Furthermore, I understand if I wish to enroll as a member directly with Momentum Fitness in the future, I may be financially liable for any facility usage I incurred after my third party program enrollment expired or was terminated.

Failed Autopays

I understand that before my payment method expires, I will receive notification emails at the email address on my profile. I understand these emails may be the only notification I receive from the business to resolve my failed payments due to the communication settings I have chosen on my profile.


I understand that when my autopay fails, my keycard will no longer work. I understand that it will be my responsibility to resolve my failed autopay by updating my payment method on file—either online or in the Momentum Fitness app—and notifying Momentum Fitness to manually re-run my failed payment. I can do this by texting 407-707-6913 or emailing accounts@momentumfit.org.


I understand that Momentum Fitness’ card processor will automatically attempt to resolve the failed autopay on their own by working with my credit or debit card company.


I understand that when my autopay fails, this does not mean my membership is officially terminated, and the above-mentioned credit card resolution process between the two companies may result in a single or multiple catch-up charges to my credit card since my membership has not been officially terminated by myself.


I understand that Momentum Fitness may terminate my membership at some point if my failed autopays are unresolved and I have taken no further action. In the event this happens and I wish to resume membership, I understand I will need to rejoin again, including the initial annual fee.

Refunds on Autopays

I understand that I will be charged a non-refundable $1 fee when initially purchasing my membership. This $1 fee is charged to store my payment method on file and will be deducted from the initial $35 annual fee charged to me upon enrollment. I understand that if I decide not to finalize my membership purchase, the $1 fee will not be refunded. 


I understand that because it is my responsibility to terminate my own membership in alignment with my autopay dates that Momentum Fitness does not offer refunds on unused/forgotten memberships. 


In the event that Momentum Fitness agrees to a refund, I understand that Momentum Fitness will retain the higher of $5 or 10% of the total refund to cover credit card processing fees.


I understand that if my membership is terminated for rules violations, I will not be issued a refund.
